The men’s lawyers, Martin Lederman and Timothy Moroney, further argued that section 922(g)(3) only applied when the person committing the drug offense had actual or constructive control over the weapon. The Supreme Court unanimously rejected these arguments, finding that the plain language of the statute did not require the government to prove that a person possessed a weapon at a specific time. The Court found that “in the case of the mere possessor, it is irrelevant whether he was under the influence of drugs at the time of his possession.” The Court held that a defendant could be convicted of possessing a weapon while under the influence if the government could establish that a gun was in the defendant’s possession while he was under the influence. Justice Clarence Thomas broke the tie for the Court, finding that McLaughlin was correctly charged.
